Visa Hurdles in the U.S.: Applications May Be Denied if Deemed ‘Anti-American’

The United States Citizenship and Immigration Services (USCIS) has recently issued a new policy stating that if a visa applicant is considered “anti-American,” their application can be denied. This policy applies to applicants for student visas, work visas, green cards, and U.S. citizenship.

USCIS spokesperson Matthew Tragesser said in an official statement, “Those who harbor hatred toward America or promote anti-American ideologies should not benefit from being in the United States. Our agency is conducting strict checks to prevent such individuals from entering.” He further added that living or working in the U.S. is not a right but a privilege.


Key Points of the Policy:

  • USCIS officers will assess whether the applicant has supported terrorist organizations or ideologies, particularly those considered anti-American, anti-Semitic, or linked to terrorism.

  • The policy allows for review of applicants’ social media posts, comments, and online activity.

  • In April, USCIS announced it would begin monitoring the social media profiles of international students and other visa applicants.

  • In June, interviews were reinstated for F-visas and M-visas (for international students) and J-visas (for exchange programs). Applicants were also instructed to keep their social media profiles public.


New Definition of ‘Good Moral Character’ for Citizenship

USCIS has also revised its definition of “good moral character.” Officers will now evaluate an applicant’s overall behavior — including negative aspects such as criminal history, DUI offenses, and unpaid taxes — as well as positive traits like education and employment history.


Concerns and Criticism from Immigration Lawyers

Noted New York-based immigration attorney Cyrus D. Mehta raised concerns about the vagueness of the policy. He stated, “Criticizing an administration should not be considered anti-American. Dissent and disagreement are fundamental to democracy and drive progress and reform.”

Another lawyer sarcastically remarked, “If you don’t clap loud enough during the national anthem, your green card could be denied. The Trump administration’s new rule may soon require immigrants to like ranch dressing.”
